Article 1 – Purpose of the Sephora Product Opinion service
1.1 Accessible at the address www.sephora.gr, the Sephora Product Opinion service is a platform that web surfers can use in order to give opinions, advice, hints, suggestions, information and recommendations regarding the products marketed by Sephora that they have tested, and to give them a score ranging from one star (for “Not for me”) to five stars (for “I love it”).
1.2 The Sephora company provides users of the Sephora Product Opinion service with an area for storing only their opinions for the purposes of their dissemination across all communication media intended for Sephora’s current and future audience, notably including but not limited to electronic communication services (notably the Internet site www.sephora.gr and/or any possible adaptation on mobile devices) and marketing and/or advertising communications media (emailing, mail shots, advertising banners on the Internet, promotional media within Sephora stores, etc.) produced by Sephoraunder the following terms.
Article 2 – Content of the Product Opinions / Responsibilities of the users
2.1 The Sephora Product Opinion service cannot be used as a means for disseminating content that violates morality, public policy, the rights of third parties, or the applicable laws and regulations, notably including:
- statements or messages of a slanderous, abusive, obscene, racist or offensive nature, or that mention illegal activities in any form;
- any abuse regarding the use of freedom of expression, such as comments that include systematic and non-objective criticism, as well as comments of a denigrating or malicious nature;
- content of a violent or pornographic nature, or that would undermine respect for persons or their dignity, equality between women and men, or the protection of children and adolescents;
- statements or messages encouraging crimes or offences, inciting violence, discrimination or racial hatred;
- unauthorised use of a name, e-mail address or company name;
- the total or partial use of content protected by an intellectual property right and for which users do not have the necessary rights, as well as messages constituting an infringement of a registered trade mark.
2.2 Users undertake not to misuse the Sephora Product Opinion service for the purposes of propaganda, prospecting, soliciting or proselytizing, whether for professional, commercial or political purposes (advertising messages, “spam” content or references to other products, commercial offers or Internet sites, etc.).
2.3 The Product Opinions must not contain:
- e-mail addresses, URLs, telephone numbers, postal addresses or any other information (surname, first name…) that would serve to identify the user;
- critical comments on the other opinions notably published on the site www.sephora.gr or regarding their authors;
- comments on the medical effectiveness of the products;
- comments relative to another product or to problems encountered when ordering (delivery problems…).
The Product Opinions must under no circumstances be drafted in exchange for any kind of compensation.
2.5 Users also undertake not to hinder or disturb the operation of the Sephora Product Opinion service.
Users will refrain from including documents, software programs or other information with the opinions placed in the storage area made available by Sephora that could damage the computers of other users or allow unjustified access to other Internet sites.
Users must take the appropriate measures relative to the hardware that they use in order to protect the said hardware from possible contamination by viruses or intrusion attempts. Hardware must be understood to include, though this list is in no way limited or exhaustive: personal computer, PDA (personal digital assistant), Internet access, software programs and data, etc.
Any opinions submitted via the Sephora Product Opinion service can be used at the sole discretion of Sephora. Sephora also reserves the right to delete any opinion, if it does not abide with SEPHORA CHARTER.
Article 3 - Intellectual property
3.1 The texts, graphic elements, software programs, music, sounds, photographs, images, videos, databases and any other work present on the Sephora Product Opinion service are protected by the intellectual property code. Users undertake not to reproduce them without the formal written approval of the Sephora company, and not to extract data from the databases used on the Sephora Product Opinion service.
3.2 By uploading their opinion to the Sephora Product Opinion service, users formally agree, at no cost, that the Sephora company can disseminate, reproduce and present all or part of their opinion as well as their username, using any reproduction or presentation means and on all media throughout the world for a period of 5 years.
The employed media can notably include graphic and paper media, audio-visual, IT and digital media such as CD-ROMs, DVDs, the Internet, as well as all other currently known or future media.
This authorisation notably allows Sephora to use, freely and at no cost, all or part of the opinions and usernames, to reproduce, modify or delete them in whole or in part, to adapt, publish or translate them, to create derived works, and to sell them or distribute them, whether for commercial, promotional and/or advertising purposes.
Article 4 - Compensation
Users bear sole liability for all of the content that they upload to the Sephora Product Opinion service.
Users undertake to guarantee the Sephora company as well as its group companies, directors, agents and partners with regard to all complaints, claims and actions initiated by third parties, and for which the cause, basis or origin is the content of the information, data, messages and statements provided by these users on the Sephora Product Opinion service.
To this end, users agree to fully compensate Sephora, as well as its group companies, directors, agents and partners, notably by reimbursing the expenses incurred in order to handle disputes and for their defence (bailiff fees, lawyers fees, etc.) and by assuming the amount of their possible sentences (damages and interest, publication costs, penalties, etc.). Users also undertake to participate in all negotiations undertaken with the plaintiff and to assume responsibility for all negotiated indemnities that may be owed to the latter.
Article 5 - Personal data
Only the fields in the data collection form followed by an asterisk are mandatory in order to be able to leave an opinion on the Sephora Product Opinion service.
Users of Sephora Product Οpinion Service have been informed that all or part of their personal data collected in this way by Sephora may be used by the latter for the issuance of statistical data (personal information optional eg city, age , gender, skin type, eye color…), or if needed by its providers, in order to draw conclusions about the preferences of the consumers in Sephora's existing and future media with the public (personal information necessary such as name, nickname), including, among others, electronic communication services (specifically the website www.sephora.gr or any possible version used in mobile devices-mobile app) and / or the means of communication, promotion and / or advertising (electronic). mail, email, online banner ads, promotional material in Sephora stores ....) that have been formulated by Sephora regarding the products evaluated.
The personal data used for this dissemination can include: the username, city of residence, age bracket and sex, skin type and eye colour of the user who uploaded the opinion.
To enable this functionality, Sephora provides your personal information to a subcontractor. This data transmission will be carried out in accordance with the appropriate guarantees and the EU and Greek legislation for the protection of personal data, in order to ensure the protection of your personal information.
Article 6 - Applicable law and competent jurisdiction
Any dispute resulting from the fulfilment or interpretation of these general terms will be governed by Greek law and fall under the exclusive competence of the Courts of Athens.
